Welcome to VanderMark Operations, LLC., dba VanderMark (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, applications, verification services, reports, and related offerings (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Services.

1. Nature of Services

VanderMark provides independent, third-party digital credibility assessments based on:

  • Publicly available information
  • User-submitted materials
  • Proprietary evaluation methods
  • AI-assisted analysis combined with human review

The Applicant acknowledges that all fees are paid for the execution of the review process itself, not for any specific outcome.

Services may include:

  • Identity and ownership verification
  • Platform-specific account analysis
  • Risk and authenticity review
  • Written findings and classification outcomes

VanderMark does not provide endorsements, character certifications, guarantees of authenticity beyond the defined scope, or assurances of future outcomes.

2. No Guarantees or Representations

You acknowledge and agree that:

  • All verification results are point-in-time assessments
  • Findings reflect professional judgment, not factual certainty
  • Outcomes may change as new information becomes available

Verification does not constitute:

  • An endorsement or approval
  • A guarantee of legitimacy, safety, or credibility
  • A prediction of future conduct or performance
  • A guarantee of platform standing, monetization, or partnerships

All third-party reliance on verification results is at their own discretion.

3. Purchase of Process (No Outcome Guarantee)

By submitting an application and payment, you expressly agree:

  • You are purchasing a professional review process, not a result
  • Approval, denial, or escalation outcomes are determined solely by VanderMark
  • Dissatisfaction with an outcome does not constitute grounds for dispute

This structure is fundamental to maintaining the independence and integrity of the verification process.

4. No Refund Policy

All fees are final and non-refundable.

By purchasing Services, you agree:

  • Work begins upon submission and/or payment
  • The value provided is the execution of the review process
  • No refunds will be issued regardless of outcome, timing, or decision

Chargebacks or payment disputes may result in:

  • Immediate termination of Services
  • Revocation of any verification status
  • Additional administrative or legal action


5. Not Legal, Financial, or Professional Advice

The Services do not constitute:

  • Legal advice
  • Financial or investment advice
  • Marketing, cybersecurity, or compliance advice

You are solely responsible for:

  • Decisions made based on verification results
  • Use or disclosure of reports
  • Compliance with applicable laws and platform policies


6. Eligibility and User Responsibilities

By using the Services, you represent that:

  • You are at least 18 years of age
  • You have the authority to submit all accounts and materials
  • All information provided is accurate and complete
  • You are the rightful owner or authorized representative

You agree not to:

  • Misrepresent identity or ownership
  • Submit false, deceptive, or manipulated information
  • Interfere with or attempt to reverse-engineer the process
  • Use the Services for unlawful or harmful purposes


7. Verification Scope and Limitations

Verification is:

  • Limited to the specific platforms submitted
  • Conducted based on information available at the time
  • Not continuous unless explicitly contracted

VanderMark reserves the right to:

  • Decline any application
  • Request additional verification steps
  • Delay, suspend, or terminate a review
  • Revoke or amend findings if new or conflicting information arises


8. Confidentiality and Proprietary Methods

Company Confidentiality

VanderMark maintains strict confidentiality over:

  • Internal methodologies
  • Risk scoring systems
  • Review frameworks and criteria

These are proprietary trade secrets and will not be disclosed.

User Confidentiality

You agree:

  • Not to disclose or misrepresent the internal process
  • Not to attempt replication, reverse-engineering, or exploitation
  • Not to present VanderMark’s work as your own

Data Handling

We use reasonable safeguards; however:

  • Absolute confidentiality cannot be guaranteed
  • Public data is not considered confidential
  • You consent to the internal use of submitted materials for review


9. Public Verification Record

If verification is granted, you agree that VanderMark may publish limited information in a public-facing record, including:

  • Account name and identifier ie. VM Number
  • Verification status
  • Verification date(s) and classification

For accounts enrolled in ongoing or maintained verification services, VanderMark may also display:

  • A record of active maintained status
  • A historical list of completed review periods or verification events associated with that account

This public record is intended to reflect continuity and consistency of verification over time, not to disclose underlying analysis, scoring, or confidential findings.

VanderMark will only publish records for accounts that have achieved verified status.
Accounts that do not meet verification standards will not be listed in the public database and may return a search result such as “No Account Found” or similar.

If a verification expires or an account is closed, a verification registry search may result in "No Account Found".

No sensitive personal data will be publicly disclosed.


10. Intellectual Property

All VanderMark materials are proprietary, including:

  • Reports
  • Frameworks
  • Language
  • Scoring methodologies

You may not:

  • Copy, reproduce, or distribute materials
  • Sell or sublicense any portion
  • Reverse-engineer systems or outputs

Limited use is granted for personal or internal business purposes only.


11. Use of Verification Results and Marks

Unless expressly authorized:

  • Verification results may not be altered or misrepresented
  • VanderMark name, logo, or marks may not be used for promotion
  • Public references must accurately reflect the scope and limitations

Misuse may result in:

  • Immediate revocation
  • Legal enforcement


12. Limitation of Liability

To the fullest extent permitted by law:

VanderMark shall not be liable for:

  • Business or financial losses
  • Reputational damage
  • Platform or third-party actions
  • Errors, omissions, or delays

In all cases, total liability shall be strictly limited to ten percent (10%) of the amount paid for the specific Service giving rise to the claim.

Under no circumstances shall:

  • Prior payments
  • Separate services
  • Ongoing or maintained service fees

be aggregated or considered in calculating liability.


13. Indemnification

You agree to indemnify and hold harmless VanderMark from any claims arising from:

  • Your use or misuse of Services
  • False or misleading submissions
  • Violations of these Terms
  • Third-party claims related to your accounts or conduct


14. Termination

We may suspend or terminate Services at any time if:

  • Terms are violated
  • Misrepresentation is suspected
  • Legal or reputational risk is present

Termination does not entitle you to a refund.


15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida.

All disputes shall be resolved through binding arbitration, unless otherwise required by law.
Venue shall be determined by VanderMark.


16. Modifications

We reserve the right to modify these Terms at any time.
Continued use of the Services constitutes acceptance of updated Terms.


17. Minors and Guardian Consent

The Services are intended for individuals 18 years of age or older.

VanderMark does not accept applications submitted directly by minors.

If a verification is requested for an individual under the age of 18:

  • The application must be submitted by a parent or legal guardian.
  • The submitting party represents and warrants that they have full legal authority to act on behalf of the minor.
  • The parent or guardian assumes full responsibility for:

    • The accuracy of all submitted information
    • Consent to identity verification and review processes
    • Acceptance of these Terms on behalf of the minor

VanderMark reserves the right to request additional documentation to verify guardian authority and may decline any application involving a minor at its sole discretion.

18. Right to Refuse or Decline High-Risk Profiles

VanderMark reserves the absolute right, at its sole discretion, to decline, suspend, or terminate any application or review that presents elevated legal, reputational, operational, or ethical risk.

This includes, but is not limited to:

  • Accounts associated with suspected fraud, deception, or manipulation
  • Activities that may expose VanderMark to regulatory, platform, or legal scrutiny
  • Incomplete, unverifiable, or inconsistent identity or ownership signals
  • Excessive risk indicators identified through internal review processes
  • Situations where sufficient confidence in verification cannot be established

VanderMark is not obligated to disclose the specific reasons for refusal or decline.

All such determinations are final and are made to preserve the integrity, neutrality, and safety of the verification system.

19. Sensitive Categories and Public Figure Considerations

Certain accounts may require heightened scrutiny due to their visibility, influence, or subject matter.

These may include, but are not limited to:

  • Public figures, influencers, or widely recognized individuals
  • Accounts operating in sensitive or regulated categories
  • Accounts involving financial, health, political, or advisory influence
  • Accounts with significant audience reach or impact

In such cases, VanderMark reserves the right to:

  • Apply enhanced review standards
  • Require additional documentation or verification steps
  • Extend review timelines
  • Decline or limit verification where appropriate

Verification in these categories reflects a measured and controlled assessment and does not imply endorsement, validation of claims, or approval of content, messaging, or influence.
